2. Purpose
The purpose of these GTC is to define the rights and obligations of the parties in the context of the sale of original artworks, reproductions (prints),
and customized creations (commissions) created and offered for sale by the Artist.

3. Products Offered
The products offered for sale include:
Original artworks: paintings, linocuts, and unique illustrations.
Reproductions: prints of existing artworks, produced in limited or unlimited editions.
Commissions: customized creations, produced digitally, upon the client’s request.
The essential characteristics of the products are presented on the Ko-fi.com sales platform or communicated directly to the client prior to purchase.

4. Orders
Orders may be placed:
via the Artist’s Ko-fi platform;
or directly by email, for orders that do not fall within the commissions offered on the Ko-fi platform.
Any order constitutes acceptance of these GTC.
The Artist reserves the right to refuse any order (including but not limited to unethical requests, reputational harm, discriminatory content, etc.).

5. Prices and Payment Terms
Prices are indicated in euros (€) and are net of tax (VAT not applicable, pursuant to Article 293 B of the French General Tax Code).
Payments are accepted via Stripe and PayPal, depending on the options available on Ko-fi or agreed upon directly with the client.
An order is deemed confirmed only upon receipt of full payment.

6. Delivery
Physical deliveries are made exclusively within mainland France, to the address provided by the client at the time of ordering.
Delivery times vary depending on the type of product:
- Physical artworks (prints, linocuts, originals): dispatched within 5 to 10 business days after payment confirmation.
- Custom digital commissions: the creation timeframe is specified prior to the order. Digital commissions are delivered exclusively by email, worldwide.
- Shipments are made using a tracked carrier (La Poste or similar).
The Artist shall not be held liable for delays or damage caused by the carrier.

7. Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, no right of withdrawal applies to the sale of:
customized works or works made to order (commissions) once creation has begun;
reproductions produced in limited editions at the client’s request;
digital works delivered by download.

However, the client may request the cancellation of a commission order only if production has not yet begun. In such case, a full refund will be issued.
8. Receipt and Complaints
The client is required to check the condition of the parcel upon receipt.
Any anomaly (missing item, damaged product, order error) must be reported to the Artist within 7 days of receipt, accompanied by photographic evidence.
No complaints will be accepted after this period.
The Artist shall not be held liable for damage caused by the carrier. Consequently, refunds or replacements cannot be provided for unique artworks or limited-edition reproductions.

9. Intellectual Property and Copyright
All artworks (originals, reproductions, commissions) are protected under the French Intellectual Property Code.
9.1. Artist’s Rights
The Artist, Lamie Heresy (Shirley MARIE), retains all moral and economic rights to her creations, unless an explicit written assignment is agreed upon.
The purchase of an artwork does not entail any transfer of exploitation rights (commercial use, reproduction, distribution, modification), unless expressly agreed in writing in advance.
9.2. Custom Commissions
The client acquires a right of private use of the artwork (personal display, non-commercial sharing on social media with proper credit to the Artist).
Any commercial, promotional, or publishing use (including but not limited to merchandising, distribution, NFTs, video games, etc.) requires a separate assignment of rights, defined in a written contract signed by both parties.
The client has no rights to use AI on any works created by the artist.

9.3. Commercial Licenses
A commercial license may be granted upon request, subject to a written agreement defining the scope of use, duration, territory, and corresponding remuneration.
In the absence of such agreement, any commercial use constitutes copyright infringement.

10. Liability
The Artist shall not be held liable for indirect damages resulting from the purchase or use of an artwork.
In any event, the Artist’s liability is strictly limited to the total amount of the order.

The information collected at the time of ordering is used solely for order processing and delivery.

12. Force Majeure
The Artist shall not be held liable for failure to perform her obligations in the event of force majeure (including but not limited to illness, natural disasters, strikes, technical failures, war, death, etc.).
13. Applicable Law and Disputes
These GTC are governed by French law.
In the event of a dispute, the parties shall seek an amicable solution as a priority.
